By creating a living trust during your lifetime, you can avoid the cost and hassle of probate upon your death. The property you transfer into the trust during your life passes directly to the trust beneficiaries after you die, without court involvement. Probate can take up to a year, and eat up three to five percent of your estate in lawyers' and court fees. When you use a living trust, the property you leave goes directly to the people you want to inherit it. Living Trusts are especially useful to maintain financial continuity for the protection of minor children.
In the event of a divorce, it is prudent to revisit Trusts and Wills. Often a Living Trust is not feasible until the divorce is final. We can craft a will to protect your beneficiaries until the divorce is final.
We also have an emergency trust for those cases when a loved one waits until they are in the hospital to think about a will or trust. These work especially well to save the time and money required in a probate.
